    Recent Wage & Hour Developments: The Rising Tide

    The explosion of wage and hour litigation continues unabated. This upward trend has been attributed to numerous factors, including the economic downturn, a greater awareness of workplace rights, media reports of large verdicts and settlements in other wage and hour cases, and an increasingly aggressive and sophisticated plaintiffs bar. Whatever the cause, this trend is expected to continue in 2011 and beyond.  In addition, employers should also be aware that the U.S. Department of Labor has also taken an increased interest in wage and hour issues.  Accordingly, this presentation will summarize key provisions of the Fair Labor Standards Act and discuss the Act's overtime requirements.   Additionally, the presentation will focus on the three main types of FLSA cases (misclassification, off the clock, and failure to pay minimum wages), good faith defenses under the act and how to avoid FLSA litigation through the development of a wage and hour compliance program.

    Juliet Burgess is a labor and employment attorney at Littler Mendelson, P.C. Juliet's law practice involves litigating labor and employment claims, as well as working with employers to develop and enforce effective policies, practices, and procedures.  She regularly represents employers before federal and state courts, administrative agencies, and in arbitration and mediation proceedings in employment discrimination, harassment, and retaliation cases, as well as other employment-related matters, such as wage and hour, non-compete and non-solicitation, wrongful termination and breach of contract matters.  Juliet also regularly provides counsel to senior management and human resource personnel on employment law compliance matters such as hiring and termination procedures, leaves of absence, reductions-in-force, workplace investigations, reasonable accommodations, and harassment and discrimination avoidance.   She received her J.D., cum laude, from the Washington College of Law, American University, Washington, D.C., 2004 and her B.A., cum laude, Psychology, University of Arizona, Tucson, AZ, 2000.  Juliet is on the Board of Directors for Angel Mamas, an Arizona non-profit organization, the Leadership Council for the Wellness Community of Arizona and the Advisory Board for the Arizona chapter of Autism Care and Treatment Today.  She is also a member of the American Bar Association, the Arizona Women's Lawyer Association, and the Arizona State Bar Association's Labor and Employment Section.
